{"id":39,"date":"2011-01-17T22:33:57","date_gmt":"2011-01-17T22:33:57","guid":{"rendered":"http:\/\/www.caassetprotection.com\/blog\/?p=39"},"modified":"2023-02-01T17:32:18","modified_gmt":"2023-02-01T17:32:18","slug":"omission-of-husband-in-elizabeth-edwards-will-is-not-the-whole-story","status":"publish","type":"post","link":"\/blog\/omission-of-husband-in-elizabeth-edwards-will-is-not-the-whole-story\/","title":{"rendered":"Omission of Husband in Elizabeth Edwards\u2019 Will is Not the Whole Story"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"line-height: 115%; font-size: 12pt;\"><span style=\"font-family: Calibri;\">Elizabeth Edwards was a thoughtful woman who always seemed sure of what she wanted, so when <a href=\"http:\/\/www.cnn.com\/2011\/POLITICS\/01\/06\/elizabeth.edwards.will\/?hpt=T1\" target=\"_blank\" rel=\"noopener\">it was revealed earlier this month<\/a> that her will left everything to her children, with no mention of her husband John Edwards, nobody doubted she knew exactly what she was doing. There has been no end of speculation in the media about <em>why<\/em> Elizabeth Edwards\u2019 will makes no mention of her estranged husband, but of more interest to me as an estate and tax planner is the fact that she <em>could<\/em> and <em>did<\/em> choose to bypass her husband in this particular estate planning document.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"line-height: 115%; font-size: 12pt;\"><span style=\"font-family: Calibri;\">A closer look at <a href=\"http:\/\/www.insideedition.com\/lib\/pdf\/5566\/edwards-final-pdf.pdf\" target=\"_blank\" rel=\"noopener\">Elizabeth Edwards\u2019 will<\/a> reveals that the section leaving \u201call of my furniture, furnishings, household goods, jewelry, china, silverware and personal effects&#8230; to my children&#8230;\u201d is not the whole story.\u00a0 Further down in her will Edwards bequeaths \u201call the residue and remainder of my property and estate&#8230;\u201d to a \u201cRevocable Declaration of Trust.\u201d It is safe to assume that most of Elizabeth Edwards\u2019 estate will be distributed according to the <em>private<\/em> terms of this Revocable Trust\u2014and it is quite possible that this trust may contain provisions for her husband.\u00a0 Whether or not the Trust mentions John Edwards is something the public may never know, and that is probably exactly how Elizabeth Edwards wanted it.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"line-height: 115%; font-size: 12pt;\"><span style=\"font-family: Calibri;\">Many husbands and wives assume that what is known as the <a href=\"http:\/\/www.associatedcontent.com\/article\/5787196\/the_perils_of_i_love_you_wills.html\" target=\"_blank\" rel=\"noopener\">\u201cI love you\u201d will<\/a> (a will that simply leaves everything to your spouse) is their only option when it comes to inheritance and estate planning; but as Elizabeth Edwards proves, this is not necessarily the case. In fact, not only are \u201cI love you\u201d wills <em>not<\/em> your only option, in most cases they are not even your <em>best<\/em> option. Revocable Living Trusts, for example, are excellent estate planning tools because\u2014in addition to being private\u2014Trusts are extremely flexible, allowing the grantors to have an extensive amount of control over how their estate will be distributed; not only immediately following their death, but possibly for years afterward.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"line-height: 115%; font-size: 12pt;\"><span style=\"font-family: Calibri;\">Elizabeth Edwards has been quoted as saying that in spite of their differences, she saw John Edwards as \u201cthe father of my children, and that&#8217;s very important to me&#8230; Particularly since I have a terminal disease, this is the person who at some point will take over the primary parenting, and it&#8217;s important to me that he heal, if he needs to.\u201d In light of this statement, it\u2019s unlikely that she would have used her will as a way to \u201cget back at\u201d or seek revenge on her husband.\u00a0 It is more likely that she chose to distribute most of her estate privately through her Revocable Trust.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"line-height: 115%; font-size: 12pt;\"><span style=\"font-family: Calibri;\">If you are interested in a Revocable Living Trust (or other advanced estate planning techniques) for your family, please <a href=\"http:\/\/www.caassetprotection.com\/contact-us.html\" target=\"_blank\" rel=\"noopener\">contact our office<\/a>.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Elizabeth Edwards was a thoughtful woman who always seemed sure of what she wanted, so when it was revealed earlier this month that her will left everything to her children, with no mention of her husband John Edwards, nobody doubted she knew exactly what she was doing.
